The short version: Use RealtorRaptor honestly and legally. Your leads are yours. Pay on time. Don't abuse the AI. We can cancel accounts that violate these terms. If something goes wrong, our liability is limited to what you paid us in the last 3 months.
1. Agreement to Terms
By creating an account or using RealtorRaptor ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of a business, you represent that you have authority to bind that business to these Terms.
If you do not agree to these Terms, do not use the Service.
2. Description of Service
RealtorRaptor provides an AI-powered chatbot and lead capture platform for real estate professionals. The Service includes:
- An embeddable chat widget for agent websites
- An AI assistant trained on real estate topics, powered by Anthropic's Claude API
- Lead capture, storage, and notification features
- A web-based dashboard for managing leads and settings
3. Account Registration
To use the Service you must create an account with accurate information. You are responsible for:
- Maintaining the security of your account credentials
- All activity that occurs under your account
- Notifying us immediately of any unauthorized access at support@realtorraptor.com
We reserve the right to disable accounts that provide inaccurate information or violate these Terms.
4. Subscription & Billing
Plans and Pricing
The Service is offered on a monthly subscription basis at the rates displayed on our pricing page. Prices are in USD and exclude applicable taxes.
Billing
- Subscriptions are billed monthly in advance via Stripe
- Your subscription renews automatically unless cancelled
- You authorize us to charge your payment method on each renewal date
Cancellation
- You may cancel at any time from your account settings or by emailing us
- Cancellation takes effect at the end of the current billing period
- No refunds are issued for partial months
- Your data is retained for 90 days after cancellation, then permanently deleted
Failed Payments
If a payment fails, we will retry up to 3 times over 7 days. If payment cannot be collected, your account will be suspended. Lead data is preserved during suspension for 30 days.
5. Acceptable Use
You agree to use the Service only for lawful purposes. You must not:
- Use the chatbot to deceive, mislead, or defraud website visitors
- Impersonate another person or business in your chatbot configuration
- Use the Service to send spam or unsolicited communications
- Attempt to reverse-engineer, scrape, or exploit the platform
- Use the AI to generate false, misleading, or defamatory content
- Violate any applicable laws including fair housing regulations and real estate licensing laws in your jurisdiction
- Share your account credentials with others outside your licensed team
Real Estate Compliance: You are responsible for ensuring your chatbot complies with all applicable real estate laws in your jurisdiction, including fair housing laws, disclosure requirements, and licensing regulations. RealtorRaptor provides a technology tool — it does not provide legal or real estate advice.
6. AI Disclaimer
The AI assistant is designed to answer general real estate questions helpfully. However:
- AI responses may occasionally be inaccurate or incomplete
- The AI does not have access to real-time MLS data or specific property listings
- AI responses do not constitute legal, financial, or professional real estate advice
- You are responsible for reviewing AI-generated content and ensuring it is accurate for your market
- We recommend using the Custom FAQ feature to provide accurate, locally-specific information
7. Data & Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
Your Data
- You retain ownership of all lead data collected through your chatbot
- You grant us a limited license to store and process this data solely to provide the Service
- We will never sell your lead data or use it for purposes other than operating your account
Visitor Consent
You are responsible for ensuring that your website visitors are appropriately informed that they are interacting with an AI chatbot and that their contact information may be collected. We recommend adding a brief disclosure near your chatbot widget.
8. Intellectual Property
The RealtorRaptor platform, including its code, design, branding, and documentation, is owned by us and protected by intellectual property law. You may not copy, reproduce, or create derivative works from any part of the Service without written permission.
You retain ownership of your custom content (agent name, FAQ entries, branding) that you upload to the platform.
9. Uptime & Service Availability
We aim for 99.5% monthly uptime but do not guarantee uninterrupted service. Planned maintenance will be communicated in advance where possible. We are not liable for downtime caused by third-party services (Anthropic API, Supabase, Railway, etc.) outside our control.
10. Limitation of Liability
To the maximum extent permitted by law: RealtorRaptor's total liability to you for any claims arising from the Service is limited to the amount you paid us in the 3 months preceding the claim. We are not liable for indirect, incidental, special, or consequential damages including lost profits, lost leads, or lost revenue — even if we were advised of the possibility of such damages.
11. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be error-free or that AI responses will be accurate.
12. Indemnification
You agree to indemnify and hold harmless RealtorRaptor and its officers, employees, and agents from any claims, damages, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any applicable law.
13. Termination
We may suspend or terminate your account immediately and without notice if you:
- Violate these Terms
- Fail to pay subscription fees
- Engage in abusive, fraudulent, or illegal activity
You may terminate your account at any time. Upon termination, your right to use the Service ends immediately.
14. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes via email at least 14 days before they take effect. Your continued use of the Service after that date constitutes acceptance of the updated Terms.
15. Governing Law
These Terms are governed by the laws of the State of Nevada, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Nevada.
